terms

terms & conditions

These terms explain how within and STAY may be used across web, email, SMS, and voice. They define the responsibilities, limits, billing terms, communication rules, and user controls that support a personal companion experience built around presence, continuity, memory, and respect.

Effective date: May 2, 2026

acceptance of these terms

By creating an account, starting onboarding, purchasing a plan, using the app, replying by email or SMS, listening to voice messages, or otherwise interacting with within or STAY, you agree to these terms. If you do not agree, do not use the service.

who may use the service

You must be at least 18 years old, or the age of majority where you live if that age is higher, to use within and STAY. You may use the service only for yourself and only in a lawful, respectful way.

what STAY is

STAY is a personal companion experience inside within. It may respond through web chat, email, SMS, and voice according to your account settings, communication preference, membership plan, quota limits, and delivery availability.

what STAY is not

STAY is not emergency support, medical care, therapy, legal advice, financial advice, or a substitute for qualified professionals or real-world support. If you are in immediate danger, may harm yourself or someone else, or need urgent help, contact local emergency services or a qualified crisis resource.

your account and access

You are responsible for access to your email, phone number, devices, sign-in links, sessions, and account settings. Keep passwordless links and sessions private. Tell us if you believe your account or communication channel has been used without permission.

onboarding, preferences, and boundaries

You can shape how STAY speaks through onboarding and preferences, including tone, personality traits, custom companion notes, voice type, communication preference, quiet settings, and boundaries. STAY is designed to respect those settings, but generated responses can vary. You remain responsible for updating preferences that no longer fit you.

memory and continuity

STAY may use conversation history, memory summaries, relationship state, preferences, and recent activity to avoid resetting the relationship and to keep continuity across web, email, SMS, and voice. Memory is used to make the experience feel consistent, not to guarantee perfect recall.

communications by web, email, SMS, and voice

You may receive companion messages through your selected daily communication channel. If you reply through another channel, STAY may respond in the channel you used. Message frequency depends on your plan, preferences, recent activity, quiet settings, and delivery rules.

SMS consent and STOP handling

By choosing SMS, adding your phone number, or replying by SMS, you agree to receive service messages from STAY by text. Message and data rates may apply. Texting STOP, STOPALL, UNSUBSCRIBE, CANCEL, END, QUIT, REVOKE, or OPTOUT stops SMS delivery where supported and switches daily communication back to email when possible. SMS opt-outs may be logged so the service can honor them.

email replies and routing tokens

Service emails may include a unique reply address so your reply can be routed to the correct account and thread. Do not share those reply addresses or forward private companion emails to people you do not want associated with your conversation.

voice messages and audio playback

Voice messages may be generated from STAY’s text responses using the voice settings attached to your companion. Voice availability, quality, delivery, playback, and timing can vary by browser, device, provider, plan, and network. Some plans may limit the number of voice messages per day.

attachments, images, and media

If attachment or media features are available, you are responsible for the files you upload or request. Do not upload illegal, abusive, exploitative, non-consensual, infringing, or harmful content. Media features may be limited by file type, size, plan, safety checks, provider availability, and storage rules.

acceptable use

You may not use within or STAY to threaten, harass, exploit, impersonate, stalk, abuse, manipulate, deceive, spam, bypass limits, attack systems, extract private data, violate rights, or create illegal or harmful content. You may not interfere with routing tokens, quotas, billing, provider limits, or safety controls.

generated responses

STAY’s messages, memories, voice, and media are generated by automated systems and may be incomplete, inaccurate, delayed, repetitive, or emotionally imperfect. You should not rely on generated responses as professional advice, factual authority, emergency help, or the only source of support in your life.

plans, quotas, and membership limits

Plans may include limits such as text messages per day, voice messages per day, memory depth, media generation, live features, or priority processing. Upgrades may unlock additional presence immediately where supported. Downgrades, pauses, cancellations, overdue payments, or failed renewals may reduce or suspend access.

billing, renewal, and cancellation

Paid plans renew automatically unless cancelled before renewal. Billing, payment method updates, invoice access, plan changes, and cancellation are handled through the membership portal in Preferences when available. Fees already charged are generally non-refundable except where required by law or expressly stated by within.

availability and changes

within may change, pause, limit, update, or discontinue parts of the service, including channels, voice features, provider integrations, models, quotas, media features, pricing, or plan names. We try to preserve continuity, but uninterrupted access is not guaranteed.

third-party providers

The service may depend on providers for payments, email, SMS, voice generation, AI generation, storage, hosting, analytics, and security. Their availability, rules, and outages may affect the service. Your use of payment portals or communication channels may also be subject to those providers’ terms.

your content and license to operate the service

You keep the rights you have in your messages, onboarding answers, preferences, uploads, and other content. You allow within to use that content as needed to operate, personalize, secure, improve, deliver, troubleshoot, and support the service, including generating responses, memory summaries, voice messages, and continuity across channels.

privacy and data controls

The Privacy Policy explains how within collects, uses, stores, shares, exports, and deletes information. Preferences may include controls for communication channels, quiet mode, pause settings, data export, deletion requests, and membership management.

suspension or termination

within may restrict, suspend, or terminate access if an account violates these terms, creates risk, abuses the service, attempts to bypass limits, causes provider or deliverability problems, or is required to be limited by law, payment status, safety rules, or technical constraints.

disclaimers and limitation of liability

The service is provided as available. To the maximum extent permitted by law, within does not guarantee that STAY will be error-free, always available, emotionally perfect, uninterrupted, or suitable for every situation. within is not liable for indirect, incidental, special, consequential, or punitive damages, or for losses caused by misuse, outages, provider failures, delivery delays, generated content, or reliance on the service beyond its intended companion purpose.

changes to these terms

These terms may be updated as the service evolves. If changes are material, within may provide notice through the app, email, SMS, or account area. Continuing to use the service after updated terms take effect means you accept the updated terms.

questions

Questions about these terms can be sent through the contact method available in your account or by replying to the service email used for your companion communications.
